The Boring Bit But Please Read Carefully

Terms & Conditions

Please note that Fresh Adventures is a division of the Fresh Creative Awards Ltd and is operated by Cloud 9 Event Management Ltd. As such we are not a travel agent and therefore please be advised that whilst we will take every care and attention to detail regarding the travel, safety and well being all of Fresh Adventurers, we are not a fully bonded tour operator. However, we will comply to all of the regulations set out as part of the Package Travel Regulations Act of 1992 as we are offering both accommodation, transfers and experiences on the ground as part of the series. For full details of the legislation which we adhere to, please see Please note that by booking a Fresh Adventure you are agreeing to our terms and conditions.

Your Responsibilities

Unless otherwise stated, all Fresh Adventurers are responsible for their own flights, travel insurance which is compulsory for participating and all extras that are incurred as part of the programme. We will retain the right to refuse participation without adequate travel insurance being in place and proof will be requested.

Fresh Adventures Payment

A £100.00 deposit will be required to reserve your Fresh Adventure by Paypal or Bacs Transfer.  All participants in the Fresh Adventures Programme must pre-pay for their trip, 8 weeks prior to departure date, without exception. Fresh will not accept any responsibility for any monies sent by post and all payments must either be made online or via direct Bank Transfer, and the details are available on request. In the case of non-payment we shall treat the booking as cancelled and reserve the right to charge a cancellation fee.

Changes to Bookings and Programmes

Any changes to the original booking such as a change of name, twin room rather than a single, additional guests etc, will be charged accordingly and all amendments must be made in writing or via email. Whilst every reasonable effort will be made to accommodate changes and additional requests, their availability cannot be guaranteed. If for any circumstances Fresh needs to make alterations to the advertised and agreed Programme then we will make every effort to find a suitably replaced agenda or excursion but we cannot make any guarantees. You have our assurances that we will always have a back up programme in place should circumstances outside of our control occur. Once an Adventure is underway, we will not make or offer any refunds to the original booking.

Provided that the major change, prior to departure is because of “Force Majeure” or “Low Bookings” then we will ensure that we notify our Fresh Adventurers well in advance. “Force Majeure” includes war, threat of war, riot, civil strife, terrorist activity, natural or nuclear disaster, fire or adverse weather conditions, technical or maintenance problems with transport, closures or congestion at airports or ports, or other similar events beyond the control of Fresh. “Low Bookings” is where the minimum number of passengers to run a tour and make it viable, as set out is not achieved. Please note that the prices detailed may be subject to change, for reasons beyond the control of the Company.

You can cancel your Fresh Adventure at any time provided that the cancellation is communicated to the Company in writing. Cancellation charges will be applied as shown as we will, as a company have had to make prepayment to guarantee the trip – such as hotels, transfers, entry fees and excursions:

60 Working Days        100% Cancellation Fee

90 Working Days        50% Cancellation Fee

Bookings that are cancelled outside of these periods are entitled to a 75% cancellation fee with the remaining 25% being retained as an Administration Charge.

Fresh reserves the right to cancel an Adventure in any circumstances but will not cancel without providing a minimum of 30 Working Days notice before departure, except for Force Majeure, Low Bookings or the failure to pay the final balance. Should we need to cancel, then all monies will be returned but no compensation will be paid in any circumstances.

All Fresh Adventurers must ensure that they are aware of all relevant passport and visa requirements and that they allow adequate time to obtain them. Please note that many countries require that passports are valid for six months beyond the period of the trip. If you fail to bring a valid passport, forget yours or miss your Adventure as a result, then Fresh will not be liable for your failure to participate in the programme.

On Your Best Behaviour

We want all of our Fresh Adventurers to have a fantastic experience but it is your responsibility to ensure that you and your travelling companions do not behave in a way which causes offence or danger to others or which risks damage to property belonging to others. In such circumstances all suppliers (e.g. hotels, transfer companies etc) will have the right to request reimbursement for any damages, which will not be the liability of Fresh. Fresh also has the right to cease the programme for that particular individual or group of individuals without any refunds or compensation payments irrespective of the circumstances.

Fit & Healthy?

All Fresh Adventurers must be satisfied that they are fit enough and able to complete the itinerary of their chosen programme as detailed online. If as part of the programme Fresh deems it necessary, then Adventurers agree to accept the authority and decisions of our employees, tour leaders, and agents whilst participating. If in the opinion of such person, the health or conduct of a Client before or after the departure appears likely to endanger the safe, comfortable or happy progress of the tour, then we may have no option but to exclude that particular Adventurer from all or part of the tour, in which case all monies paid will be forfeited and we will not be liable to pay any compensation.

Anyone suffering from illness or disability or undergoing treatment for any physical or medical condition must declare the true nature of such condition at the time of booking and make arrangements for the provision of any medication or other treatment required during the tour. Failure to make such disclosure will constitute a breach of the Booking Conditions and may result in such persons being excluded from the tour in which case all monies paid will be forfeited and Fresh will not be liable to pay any compensation whatsoever.

It is of the utmost importance to us to ensure your safety, so for example, if the programme includes a River Cruise, please notify us if you cannot swin so that we can make extra safety precautions. This wont exclude you but will allow us to but extra safeguards in place.

We welcome Fresh Adventurers with disabilities but you must notify us in advance so that we can ensure your full and complete participation in the programme, advise if it is not suitable, or make additional arrangements to ensure your enjoyment.

Customs & Local Laws

If you are undertaking a Fresh Adventure then you are required to obey the laws and regulations of the countries visited. Failure to do so may result in the Adventurer being asked to leave the programme without refund or compensation.

We like to think that we will not give you reason to complain, but if you do have an issue, then in the first issue, please raise it with your appointed head of the Fresh Adventure Programme for that particular trip. Failure to complain at the time will affect our ability to rectify the situation or obtain you any compensation or refunds if appropriate. Should the problem remain unsolved a complaint must be made in writing to Fresh within three months of the Adventure. If no reasonable agreement can be made, then we will notify you of the next steps which you can take which include referral to the Chartered Institute of Arbitrators.

Missed/Delayed/Cancelled Flights

If as part of your programme you miss a flight then it is your own responsibility to arrange a transfer in order to catch up with the rest of the party. If however, your flight has been cancelled or delayed or it is missed in circumstances beyond your control, then Fresh will make every effort to ensure you receive another transfer. Compensations or refunds however will not be paid and you should contact your airline for compensation.

Special Stuff

If you have any special requests or specific dietary issues, please let us know at the time of your booking. Whilst we want all of our Fresh Adventurer to have a fabulous time, we cannot make any guarantees about any special requests, we will however do our best. Requests that include any additional charges to Fresh, will be passed on the Adventurer in question.
